Terms and Conditions 

These terms and conditions apply to all orders placed on the online shop of PYJANNA at www.pyjanna.com (hereinafter referred to as "the online shop"). They govern all purchase agreements made online by a consumer with Anna Schmidrathner (hereinafter referred to as "we" or "PYJANNA"). We recommend our buyers (hereinafter referred to as "you" or "the customer") to read these terms and conditions thoroughly before using the online shop or placing an order. These terms and conditions may be updated and amended, so please check them before every order in the online shop.

2. Conclusion of Contract The presentation of products in the online shop is not a legally binding contract offer but an invitation to order. To place an order, follow the online ordering process, add the desired items to the virtual shopping cart, and complete the order process on the checkout page. You have the opportunity to review your order and then click "Complete Order" to proceed to your chosen payment method. By doing so, the customer submits a legally binding contract offer for the items in the shopping cart. After receiving your purchase offer, you will receive an automatic order confirmation ("order confirmation email") to the email address provided by you. Note that this does not mean your order has been accepted; it merely documents the receipt of your order. A binding purchase agreement is concluded once your order is accepted by PYJANNA, and a shipping confirmation email is sent to the email address provided by you. The order can only be placed if the customer has accepted these terms and conditions by checking the checkbox "I AGREE TO THE TERMS AND CONDITIONS AND REFUND POLICY." Contract languages are German and English. An order is possible for both registered customers and guest customers.

3. Prices & Inventory Occasionally, information in the online shop may contain errors or inaccuracies related to product descriptions, prices, promotions, offers, and availability. We reserve the right to correct errors or inaccuracies, update information, or cancel orders at any time without prior notice (even after you have placed your order). If an item is no longer in stock before the correct update of the status in the online shop, PYJANNA will notify the customer via email. An alternative product will be suggested, or the respective order will be canceled, and the purchase price will be fully refunded. In case of incorrect price indications, you have the option to purchase the item at the correct price or cancel the order. PYJANNA reserves the right to cancel a purchase contract in case of suspected fraud. Prices in our online shop are final prices in Euro (€) and include the legal value-added tax but exclude shipping costs, which are specified separately during the ordering process. For deliveries to countries outside the European Union, additional costs such as payment fees and customs duties may apply and are borne by the customer. Read our shipping and return page here. 4. Discounts & Coupons We reserve the right to change prices and discounts from time to time without prior notice. Gift voucher codes or discount codes are valid only once per person (unless stated otherwise) and only within the specified period. They may not be combined or transferred to another purchase. Gift cards cannot be purchased with discount codes. From time to time, we offer product bundles at a discount. If you buy two items that are part of a bundle offer, you may receive a discount on one or more of these items. If you only return the non-discounted bundled item, the discount on the retained discounted bundled item becomes void. In this case, you will only be refunded the amount up to the regular cost of the retained item.

5. Payment Payment is currently only possible in the currency specified in the online shop, Euro (€). Payment can be made by credit card, debit card, Klarna (Sofort), Ideal, or PayPal. Payment is due immediately after the conclusion of the contract, unless the parties have agreed on a later payment date. In case of outstanding payment, PYJANNA reserves the right to suspend shipping until the full amount is received. A purchase may be declined if payment is not made or fraud is detected.

6. Object of the Contract The nature of the ordered goods is determined by the product descriptions in the online shop. Images on the website may inaccurately represent the products, especially for technical reasons. Images are for illustration purposes only and may differ from the actual product. Descriptions of specifications, weight, dimensions, and performance are as accurate as possible but may have common variations.

7. Shipping Prices & Times PYJANNA accepts and processes orders in the same order they are received in the online shop. The delivery of goods depends on availability. The processing time is usually 1-5 business days. All shipping costs are specified during the ordering process to make the costs clear to you before completing the order. 8. Delivery If an order sent to you is returned as undeliverable, we reserve the right to charge you a fee covering the shipping costs. If your order is delayed, you will receive a notification by email. You can cancel the order and receive a full refund if you do not accept the proposed new delivery time. If the order has already been shipped, you must return the ordered items to receive a refund. All shipped items are insured by PYJANNA up to a certain amount. If you notice damage before opening the package, please take a photo and report it to our customer support as soon as possible: anna@brokesolutions.at. Items damaged during transport must be returned and replaced by PYJANNA at no cost. If you have already opened the package when you notice the damage, read Section "10. DAMAGED PRODUCTS."

9. Returns & Exchanges You have the right to return or exchange your items at any time within 14 days of delivery. To return an item, follow the instructions on our Shipping & Returns page. The customer bears the cost of returning the order if STANDARD shipping was chosen. Ensure that the items to be returned are unworn, unwashed, and neatly folded, including all labels, for a full refund. Feel free to use our packaging for shipping your return package. Please note that responsibility for the return lies with you until it reaches us. Therefore, we recommend that the return be insured and traceable. PYJANNA will refund the item price as soon as possible, no later than 30 days from the date the item is returned and received by us. The payment will be made to your original payment method. If your return is not made within the 14-day period or if the returned items do not match the original quality, we will refund your order only with a gift voucher. If you want to exchange your order for a different size, color, or style, you can place a new order in our online shop. You can also contact us if you need assistance!

10. Damaged Products PYJANNA ensures that all products undergo multiple quality control procedures before being shipped to our customers. We work hard to avoid damages or defects in our products. If you receive a defective item, please email us within 14 days of delivery with a photo of the defect. If the defect can be easily repaired, we offer you the option to take it to your local tailor. Repair costs are covered by us. If you prefer to exchange your item for a new one, we will replace your item with a new copy of the respective item, if available. If no new item is available, you will be refunded the original cost of the item and return shipping costs. We will refund you as soon as possible, no later than 30 days from the date the item is returned to us and we have determined that the item is damaged or otherwise defective. Payment will be made to your original payment method.

11. Right of Withdrawal You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day you or a third party, other than the carrier, takes possession of the goods. To exercise your right of withdrawal, you must inform us by email: anna@pyjanna.com, by sending a clear statement of your decision to withdraw from this contract.

12. Color Representation We cannot guarantee that the colors shown in the online shop correspond to the actual colors of the clothing. Colors may vary depending on computer or mobile screens and settings.

13. Retention of Title The delivered goods remain the property of the seller until full payment is made.

14. Pre-orders All pre-orders must be fully paid at the time of placing the order. Note that the shipping date is only an estimate and may change. In case of significant production or delay issues, you will be notified by email. If you change your mind, you can cancel your pre-order at any time, as long as it is not within 2 days after the specified shipping date and the order has not been shipped. After that, our standard return policy applies. Orders containing both pre-order items and immediately available items will be split and shipped separately. Unfortunately, we cannot combine the ordered items in this case.

15. Contests These terms and conditions apply to all contests conducted by PYJANNA (hereinafter referred to as "the organizer"). Each participant accepts these terms and conditions by participating. The organizer's contests are not affiliated with Meta. They are not sponsored, endorsed, or organized by Instagram or Facebook and do not establish any legal claims against the company Meta. All information related to the contests is provided exclusively by the organizer. Any natural person who is at least 18 years old is eligible to participate. The organizer reserves the right to exclude individuals from participating who violate these terms and conditions or attempt to gain an advantage over other participants through improper influence or manipulation of the contest. In such cases, the organizer may exclude participants retrospectively, withdraw and reclaim prizes. Participation is only possible within the time frame specified in the contest description. Each participant may only participate once in an identical contest. Employees of the contest organizer, as well as employees of companies involved in this contest and their immediate family members, are excluded from participating in the contest. The winner will be drawn from the participants immediately after the deadline. A change or cash payment of the prize is excluded. The prize is not transferable. The winner will be notified by email or Instagram Direct Message by the organizer. Each participant notified in this way is obliged to inform the organizer within one week after sending the notification whether he accepts the prize. If the organizer does not receive a corresponding message within this period, the possibility to accept the prize expires, and the organizer reserves the right to determine another winner. The organizer uses the data received from participants in the context of participating in the contest to carry out and process the contest. You can object to the storage and use of your data for this purpose at any time by email to: anna@pyjanna.com.

16. Final Provisions If a provision of these terms and conditions is ineffective, this does not affect the validity of the remaining provisions. In place of the ineffective provision, the respective legal regulations apply. Austrian law applies. Place of performance and jurisdiction is, as far as legally permissible, for deliveries and payments as well as for all disputes between the parties, Austria. For consumers, the place of performance and jurisdiction is the buyer's place of business.
